Our small community of 35 homes has recently started an HOA. The covenants and by laws are recorded. We are in the process of creating an Architectural Rules/Guidelines document. What is the best way to roll this out to the homeowners? According to the covenants, the original document must be approved by the majority of the owners. Please help.

Rules and Regulations simply "flesh out" the CCRs. So study them and see what needs to be detailed out. Many times the CCRS give the power to the Arch. Comm. to establish all the details.

For example, if the CCRs only says that fences can be constructed, then the Arch Comm. decides what kind, how tall, etc.

Your Committee can set up other committees, such as a color selection for paint committee, for example, before deciding on the choices the Members can have.

I headed a committee that did an entire set of ARC guidelines. What we did was to write/create them and of course followed the CC&Rs as the heirarchy for the rules. Once they were completed by the committee, they were sent to the enitre Board for their review and input. Then the draft was sent to a lawyer for all of the legal language.

After coming back to the Board/association, Florida law states that all ARC guidelines must be completely spelled out and the members must have a copy for their review 14 days prior to any vote BY THE BOARD. Unless your governing documents say that the members approve such a document, it is the duty of the Board to accept these rules and guidelines.
