| Our HOA currently is voluntary. We have 35 sets of covenants (for 35 units) for the community. The HOA has bylaws, and we are working on revising them. Does anyone have any suggested language to put into the revision such that, when the time comes and we do have mandatory membership, we won't have to change the bylaws again? While we feel that we can get mandatory membership, it requires that each unit pass an amendment to their covenants to make membership mandatory. Finding an easier way is what we are trying to do, too. The people on this forum are smart, and I know someone out there probably has the perfect answer to our woes. Thanks |

LeeS1, I have read a majority of the posts on this site. You will receive many varying opinions. I’m learning much of this myself. Being new to HOA;s , wording, languages and understanding of the bylaws is one of the biggest challenges for me. I have found that many of the bylaws were established in good intent but aren’t very practical. I have (like thousands of others) put various topics on this discussion board and have gotten some very good advice. I appreciate all the responses I have gotten. I have learned a lot from what others have experienced in their communities. The opinions of others BOD in other neighborhoods will make my community a better place for me and my neighbors. I can’t give you much advice myself, but I’m sure if you have the time you can go to the search box and type in some key words. I’m sure you would find something there. Good luck. | Lee, if you want to change from a voluntary HOA with volunary dues to manditory membership with associated manditory assessment I recommend you start with the Covenants. One Declaration of CC&Rs should be drafted, approved and notorized by each and every owner of each unit, and filed with the County Clerk. That will probably be impossible to achieve; but if you can then you can think about changing the By-laws. Otherwise you can not require joining and paying dues to a "social club" which your HOA currently is. |
