I found another section of our CC&R's that might apply to "no fences being constructed in the front yards". Any one have an interpretation of the following:

Any fences and walls sought to be constructed on any lot shall require the specific approval of Association or it's Architectural Review Board as to location, size, composition, configuration, exterior materials, color and other similar matters, which approval may be withheld for purely aesthetic considerations. No hedge, shrubbery or vegetation of any kind shall be grown or placed in the form of a fence on any of the lot or lots herein referred to across the front street line of the said lot or lots, or on either side lines of the said lot or lots within twenty20') feet of the front property line of the said lot or lots until such time the Association approves the same.

Any help interpreting this would be appreciated.

Seems pretty straight forward:

1) Fences have to be approved. (I don't like the wishy-washy wording of "purely aesthetic" - it's very subjective.) to prevent a large number of different kinds of fences, why doesn't the board come up with a choice of 3 - 4 fences that all coordinate together, and let the HO choose from those options.

2) No hedges or shrubbery can be planted so as to appear as a fence in the areas designated.

. . . and basically, you can't "fence in" your front yard.

It appears as though the fence can only be constructed in side/rear of house, probably from the edge of the front on back (since the house set back is probably the same).

Just as guess though.

Before setting a style(s) of fence or the material(s) they may be constructed from check with the zoning regulations in your city/county to make sure you are in compliance. You can make your requirements more stringent than the local code but you can't allow things that are forbidden by law.
