Subject: As built plans from Developer

Our HOA board requested 'as-built' plans from our condo developer (at our cost) for our records and for any future repair/renov. They refused stating that that they are not 'legally obligated' to do so. We have strong reasons to request these 'as-builts' vs. getting the set submitted to the building department (hard to acquire too) since it is suspect that the building is not built as per proposed plans. Do we have any recourse in this?

Cuong-The Developer is not legally obligated to provide "as builts". Have you gone through your Transition Engineering Evaluation? A set of plans (may not be "as builts") should be provided to the Transition Engineer performing the study and the process will reveal if the building conforms to state building codes. Deviations from proposed plans can and often do occur. There is usually a good reason and this should be on file with your borough's municipal engineer. Gerald
