Can a person who is not the owner of a home, but has power of attorney be a member of the HOA Board of Directors?
The person does not live on the premises.

I believe he can but only if the Owner sign over all his right as an owner, including voting rights. That would mean the owner would have NO rights to use the property and I suppose would have to be the quest of the one holding power of attorney. Not sure though.

Bernard, this depends on what your By-laws state are the requirements to qualify to be a Board member. In many associations a Board member does not even have to own property. In most the owner does not have to live on their property. But if in your association a Board member must be an owner I do not think power of attorney equals ownership.
